The ICP Filing Management regulation for China(part 1)

1 、These regulation are formulated to regulate the ICP filing and management of non-operational internet information services, promote the healthy development of the internet information service industry, and in accordance with the provisions of the “Internet Information Service Management regulation,” the “Telecommunications Regulations of the People’s Republic of China,” and other relevant laws and administrative regulations.

 2、 These regulation apply to non-operational internet information services provided within the territory of the People’s Republic of China, and the ICP filing procedures and management shall be implemented in accordance with these regulation.

 3、 The Ministry of Industry and Information Technology of the People’s Republic of China (hereinafter referred to as the “MIIT”) provides supervision and guidance for the national non-operational internet information service ICP filing management work, and the provincial, autonomous region, and directly-administered municipality communications administration bureaus (hereinafter referred to as the “provincial communications administration bureaus”) are responsible for the specific implementation of non-operational internet information service ICP filing management work. Those who intend to engage in non-operational internet information services shall complete the ICP filing procedures with the provincial communications administration bureau where their domicile is located.

 4、 Provincial communications administration bureaus shall follow the principles of openness, fairness, and impartiality in ICP filing management, provide convenient, high-quality, and efficient services, and non-operational internet information service providers shall comply with relevant national regulations when engaging in non-operational internet information services and accept supervision and management by relevant departments in accordance with the law.

 5、 Non-operational internet information services provided within the territory of the People’s Republic of China shall complete ICP filing procedures in accordance with the law. Without ICP filing, non-operational internet information services shall not be provided within the territory of the People’s Republic of China. The term “non-operational internet information services provided within the territory of the People’s Republic of China” refers to organizations or individuals within the territory of the People’s Republic of China that provide non-operational internet information services through websites accessed via internet domain names or websites accessed only via internet IP addresses.

 6 、Provincial communications administration bureaus shall use the MIIT ICP filing management system to conduct ICP filing management through online ICP filing.

 7 、Those who intend to engage in non-operational internet information services shall truthfully fill out the “Non-operational Internet Information Service ICP filing Registration Form” (hereinafter referred to as the “Registration Form,” the format of which is attached to these regulation) through the MIIT ICP filing management system and complete the ICP filing procedures. The MIIT adjusts and publishes the “Registration Form” according to the actual situation.

 8 、Those who intend to engage in non-operational internet information services through access to operational internet networks may entrust internet access service business operators, internet data center business operators, and telecommunications business operators that provide access services to their websites in other ways to complete ICP filing, ICP filing changes, ICP filing cancellations, and other procedures on their behalf.

 9、 Those who intend to engage in non-operational internet information services through access to public welfare internet networks such as the China Education and Research Computer Network, the China Science and Technology Network, the China International Economic and Trade Internet, and the China Great Wall Internet may entrust public welfare internet network units that provide internet access services to their websites to complete ICP filing, ICP filing changes, ICP filing cancellations, and other procedures on their behalf.

 10 、Internet access service business operators, internet data center business operators, telecommunications business operators, and public welfare internet network units (hereinafter collectively referred to as “internet access service providers”) shall not complete ICP filing, ICP filing changes, ICP filing cancellations, and other procedures on behalf of organizations or individuals known or should have known to engage in non-operational internet information services with untrue ICP filing information.


 11、 Those who intend to engage in internet information services such as news, publishing, education, medical care, drugs and medical devices, culture, radio, film, and television programs that require review and approval by relevant competent authorities in accordance with laws, administrative regulations, and relevant state regulations shall submit relevant competent authority review and approval documents to the provincial communications administration bureau where their domicile is located when completing ICP filing procedures. Those who intend to engage in electronic bulletin services shall submit special ICP filing materials for electronic bulletin services to the provincial communications administration bureau where their domicile is located when completing ICP filing procedures.

 12 、Provincial communications administration bureaus shall complete ICP filing within 20 working days of receiving the ICP filing materials submitted by the ICP filing party if the materials are complete, issue the ICP filing electronic verification mark and ICP filing number, and publish relevant ICP filing information to society through the MIIT ICP filing management system. If the materials are incomplete, the provincial communications administration bureau shall not complete ICP filing and shall notify the ICP filing party of the reasons within 20 working days.

 13 、Non-operational internet information service providers should indicate their ICP filing number in the central position at the bottom of the homepage of their website when it is opened, and link to the MIIT ICP filing management system website as required below the ICP filing number for public inquiry and verification. Non-operational internet information service providers should place the ICP filing electronic verification mark in the designated directory of their website according to the requirements of the MIIT ICP filing management system when their website is opened.

 14、 Non-operational internet information service providers who need to change the information reported in their “ICP filing Registration Form” during the ICP filing validity period should log in to the MIIT ICP filing system 30 days in advance to complete the ICP filing change procedures with the original ICP filing authority.

 15、 Non-operational internet information service providers who need to terminate their services during the ICP filing validity period should log in to the MIIT ICP filing system on the day of service termination to complete the ICP filing cancellation procedures with the original ICP filing authority.
